1. About these terms

These Terms and Conditions ("Terms") govern your use of the website edessakebab.ca (the "Site") and any order you place through it with Edessa Kebab ("we", "us", "our"), located at 1659 Dollard Avenue, LaSalle, Quebec, Canada.

By using the Site or placing an order, you confirm that you have read, understood and accepted these Terms. If you do not agree with them, please do not use the Site.

2. Who may use the Site

You must be of legal age to enter into a binding contract in your province of residence, or have the consent of a parent or legal guardian, to place an order. You agree to provide accurate, current and complete information when ordering.

3. Menu, availability and product information

We make reasonable efforts to keep menu items, descriptions, photos and prices accurate and up to date. Photos are for illustration only and the item served may differ in appearance. Items may be unavailable or sold out at any time, and we may modify or withdraw items without notice.

If an item you ordered is unavailable after your order is placed, we will contact you to offer a substitution, a partial refund or a cancellation of the order.

4. Allergies and dietary information

Our food is prepared in a kitchen where allergens including gluten, dairy, eggs, nuts, sesame, soy, mustard and sulphites are present. We cannot guarantee that any item is free of a given allergen or free of cross contamination.

If you have a food allergy, intolerance or other dietary restriction, please contact us by phone before ordering. You are responsible for making sure that what you order is suitable for you.

Where we describe items as halal, vegetarian or otherwise, that description reflects information provided to us by our suppliers and our own preparation practices, and is given in good faith.

5. Placing an order

An order placed through the Site is an offer to purchase. The contract is formed only when we accept and confirm the order. We may refuse or cancel an order, before or after confirmation, for reasons including product unavailability, a pricing or description error, suspected fraud, an incomplete or incorrect address, abusive behaviour, or circumstances beyond our control.

Please review your order carefully before submitting it, including items, quantities, options, pickup or delivery choice, address and contact details. Once an order is submitted and sent to the kitchen, it may no longer be possible to modify or cancel it.

6. Prices, promotions and taxes

All prices are shown in Canadian dollars and exclude applicable taxes (GST and QST) unless stated otherwise. Taxes, delivery fees, service fees and any tip you choose to add are shown before you confirm payment.

Promotions, discounts and coupon codes are valid only for the period, items and conditions stated, cannot be exchanged for cash, and may not be combined unless we say so. We may modify or end a promotion at any time. Any discount that is applied automatically at checkout is applied as displayed in your order summary at the time of the order.

In the event of an obvious pricing error, we reserve the right to correct the price and to offer you the choice of confirming the corrected order or cancelling it with a full refund.

7. Payment

Payment is made online at the time of the order through our payment provider, or in person at the restaurant where that option is offered. We do not store your full payment card details. Card data is processed by a third party payment processor that is responsible for the security of that processing.

By submitting payment information, you confirm that you are authorized to use the payment method.

8. Pickup

For pickup orders, we will indicate an estimated ready time. Times are estimates and may vary with kitchen volume. Please bring your order confirmation. Orders that are not picked up within a reasonable time after the ready time may be discarded for food safety reasons, without refund.

9. Delivery

Where delivery is offered, it is available only within our delivery zone and during our delivery hours. Delivery times are estimates and are not guaranteed. Delays may result from traffic, weather, volume or other factors outside our control.

You are responsible for providing a complete and accurate delivery address and a phone number where you can be reached. If the driver cannot deliver because the address is incorrect, access is blocked or nobody is reachable, the order may be treated as delivered and no refund will be issued.

Risk in the food passes to you on delivery, or on pickup for pickup orders.

Some deliveries may be carried out by a third party delivery partner. In that case the partner's own terms may also apply to the delivery portion of the service.

10. Cancellations, refunds and problems with an order

Because food is prepared to order and is perishable, orders generally cannot be cancelled once preparation has started.

If something is wrong with your order, such as a missing item, an incorrect item or a quality problem, contact us by phone at 438-375-4118 or by email at [email protected] as soon as possible and in any case within 24 hours of pickup or delivery. Please keep the item and your receipt, and provide photos if we ask for them.

Where a claim is justified, we will offer, at our discretion, a replacement item, a credit or a refund of the affected portion of the order. Refunds are issued to the original payment method and may take several business days to appear, depending on your financial institution.

Nothing in this section limits the rights you have under the Quebec Consumer Protection Act or other applicable law.

11. Acceptable use of the Site

You agree not to use the Site to place fraudulent or false orders, to interfere with or damage the Site or its security, to use automated tools to extract data, to copy or reuse our content for commercial purposes without our written consent, or to post content that is unlawful, defamatory, abusive or infringing.

We may suspend or refuse service to any user who breaches these Terms.

12. Reviews and content you submit

If you submit a review, comment, photo or other content, you grant us a non exclusive, royalty free, worldwide licence to use, reproduce and display that content in connection with our business. You confirm that you hold the necessary rights to the content and that it is not unlawful or misleading. We may remove any submitted content at our discretion.

13. Intellectual property

The Site and its content, including text, menus, photographs, graphics, logos and the name Edessa Kebab, are protected by intellectual property laws and belong to us or to our licensors. You may view and print the content for your personal, non commercial use only. Any other use requires our prior written consent.

14. Third party services and links

The Site relies on third party services, including our online ordering platform, our payment processor, mapping services and delivery partners. The Site may also link to third party websites and social media pages. We do not control those services and are not responsible for their content, practices or availability. Their own terms and privacy policies apply to your use of them.

15. Availability of the Site

We make reasonable efforts to keep the Site available, but we do not guarantee uninterrupted or error free access. We may suspend, withdraw or restrict access to all or part of the Site for maintenance or other reasons without notice.

16. Disclaimer

Except where the law provides otherwise, the Site and its content are provided on an "as is" and "as available" basis, without warranty of any kind, whether express or implied.

17. Limitation of liability

To the extent permitted by applicable law, our total liability arising out of or in connection with an order or your use of the Site is limited to the amount you paid for the order concerned.

We are not liable for indirect, incidental or consequential damages, including loss of profit, loss of opportunity or loss of data. We are not liable for a failure to perform caused by an event beyond our reasonable control, including supply shortages, equipment failure, labour disruption, extreme weather, power or network outages, public health measures, or acts of a public authority.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for bodily injury caused by our fault, or the rights granted to consumers under the Quebec Consumer Protection Act.

18. Indemnification

You agree to indemnify and hold us harmless from any claim, loss or expense arising from your breach of these Terms or your unlawful use of the Site.

19. Privacy

Personal information collected through the Site is handled in accordance with our Privacy Policy, which forms part of these Terms.

20. Changes to these Terms

We may update these Terms at any time. The version in force is the one published on the Site at the time you place your order. The date at the top of this page indicates when it was last updated. Continued use of the Site after a change means that you accept the updated Terms.

21. Governing law and language

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Any dispute is subject to the exclusive jurisdiction of the courts of the judicial district of Montreal, subject to the rights of consumers to bring proceedings in the district of their residence.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in effect.

A French version of these Terms is available. In case of any discrepancy between the two versions, the French version prevails.
